REMEMBER THAT THE INSURANCE COMPANIES WILL MOST LIKELY BE WORKING AGAINST YOU. This means that anything you say to anyone may wind up costing you. Don't make any kind of a statement until after you have consulted a lawyer.
OBTAIN PROMPT MEDICAL ATTENTION. Seek the medical attention that you need. Don’t delay hoping that your injuries are going to just go away. Many injuries may not be detected except through a through physical examination by a neurologist, orthopedic surgeon, chiropractor or other medical professional. Some injuries may actually heal better if you obtain prompt attention.
FOLLOW THE ADVICE that your medical providers give to you. Don’t delay.
CONTACT YOUR INSURANCE AGENT OR COMPANY. Ask your company what documents are needed to support your claim. Keep records of all paperwork related to your claim such as a copy of accident report, notes from accident scene, photographs, and records of bills and expenses. If anyone in your vehicle was injured, ask your insurance company about medical payments or PIP coverage. You should not make any statements or mail in any paperwork until you have talked with an attorney.
CONTACT THE OTHER PARTY’S INSURANCE COMPANY as soon as possible. Remember, DO NOT sign any documents or give any recorded statements until you have had the opportunity to meet with an attorney to advise you as to the consequences of those actions.
TAKE PICTURES. Your bruises, cuts or burns may be gone in a few weeks. The only way to maintain an accurate record is to take the photographs now. Don’t forget to take pictures of the car. You should take at least a dozen photos, before the car is repaired or towed away. Include pictures from every angle, documenting how much damage was done by the impact.
GET NAMES, ADDRESSES AND PHONE NUMBERS of everyone who saw the accident or was present in your car.
WRITE OUT YOUR OWN ACCOUNT of the accident, but give it to no one, except your attorney. Be sure to include a list of all of your injuries.
FOLLOW UP ON MEDICAL TREATMENT. You may become progressively more sore for a period after the crash. Obtain necessary medical treatment if new symptoms develop.CONTACT A LAWYER RIGHT AWAY. The insurance company may offer you money right away. Don’t take it. If you have taken the insurance company's check for $2,000 on the second day after the accident, you can NEVER GO BACK to get more compensation, even if you find out that your injuries are permanent and disabling.
